Attorneys File Appeal in Lawsuit Against District 113A Officials

The original complaint—filed in 2010 by former board member Janet Hughes and Lemont residents Laura Reigle, Duane Bradley and Louis Emery—was dismissed with prejudice in March.

A former school board member and three Lemont residents filed an appeal Friday in their $12 million lawsuit alleging illegal spending and concealment in Lemont-Bromberek Combined School District 113A. Natalie Potts, executive director of the Center for Open Government IIT Chicago-Kent College of Law, confirmed that attorney Clint Krislov appeared in Cook County appellate court on behalf of former District 113A board member Janet Hughes and Lemont residents Laura Reigle, Duane Bradley and Louis Emery to challenge the dismissal of the lawsuit March 15. "Appeals take several months to get going, so we're in the beginning of that process," Potts said. "We'll file an appeallate brief this summer, and the defendants will get the chance to …

I thought that the school has a deductible to meet before the insurance covered the bills. Is that true (I thought I heard $50,000)? Do you know if the legal insurance has increased since this lawsuit was filed and if so, by how much? The district is still paying for all of Dr. Ricker expenses regarding this lawsuit (when he has to meet with the attorney)-does the legal insurance cover this or is…   more ›

This makes no sense. Bradley either 1) can't count -- submitting his nominating papers with 700 fewer signatures than needed, 2) can't read instructions or 3) purposely tried to skirt the rules to get on the ballot. Conduct that doesn't give a very good testament as to why he should hold public office. The guy came in dead last in a local SB election why does he think he can and should be elected…   more ›

Lemont Resident Duane Bradley Removed from March Republican Primary Ballot

Sen. Christine Radogno (R-Lemont) will run unopposed in the 41st District after the Illinois State Board of Elections ruled that Bradley lacked enough signatures on his nominating petition.

Lemont resident Duane Bradley has been removed from the March 20 Republican primary ballot for the 41st Senate district, according to the Illinois State Board of Elections. In a hearing held Monday morning in Chicago, the Illinois State Officers Electoral Board sustained an objection filed Dec. 9 by Homer Township Highway Commissioner Michael DeVivo against Bradley's nominating petition, according to the state board's website. The objection claimed Bradley had only 300 of the required 1,000 signatures before the Dec. 5 filing deadline, according to Rupert Borgsmiller, executive director of the Illinois State Board of Elections. A hearing examiner reviewed DeVivo's objection before submitting a recommendation to the state's General Counsel…

In the objection, DeVivo claims Bradley's petition for candidacy only contains 300 signatures, Borgsmiller said. The minimum amount required is 1,000. Jorg, I think you have an agenda other than seeking the truth. That is really sad. Where in the article did it say Malley and Aurelio were incorrect? Were funds moved without board approval? That should be a simple yes or no.   more ›

The amended complaint was filed Monday in Cook County court.

Filed on behalf of attorney Clint Krislov of Krislov and Associates, the lawsuit claims District 113A officials "engaged or aided in illegal spending, and then took steps to conceal expenditures by draining funds legally appropriated for other purposes, all in violation of Illinois law," which allegedly resulted in the loss of $12 million in taxpayer money, the complaint said. UPDATED: Court Dismisses Request for Criminal Restitution in 113A Lawsuit; Plaintiffs Will Refile Civilly

Is there a lawyer in the house? "The first count, which addresses the claims against board members and administrators, was dismissed without prejudice, with leave to refile the complaint with more particularity as to each defendant's actions, and whether they are being sued in their personal or official capacity."; taken from above. Does this mean that the judge wants the prosecuting team to list…   more ›

District 113A Candidates Square Off at Tea Party Event: Live Forum Blog

All nine candidates are present as the District 113A candidate forum gets underway at the Lemont Township Community Center.

Proft asks all candidates if any of them have accepted campaign contributions from the Tea Party. All candidates say no. Proft gives candidates the opportunity to ask their own questions of specific candidates. All decline except Aurelio and Hughes. Q: Would current board members support not using the $20 million bonds all at once, that way the board can recall the bonds if they do not need them? (Asked by Aurelio of the current board members) Taylor: Declines to answer the question. Says there are certain rules about discussing board issues in the public, and because there were a certain number of board members present, he says he feels uncomfortable answering. Murphy: Says the board is governed by certain laws, and that it would be very …

Kristi, No I am not questioning whether PMA was seeking TAW's and couldn't secure them. I have catapulted past that and all past matters frankly. Now, I am pondering Mr Ricker's thoughts about how money should be spent, in the future, by the district. He said, basically, that the district and the new BOE has to hear from the community on how to spend the monies. I know that more scrutiny will be …   more ›
