Madigan Asks for 7th Circuit Gun Ruling Review

The Illinois attorney general says the entire court of appeals should rule on the legality of the state's conceal carry ban.

 

Illinois Attorney General Lisa Madigan has asked the entire 7th Circuit Court of Appeals to review a December ruling that overturned the state's ban on the concealed carry of handguns in public.

The Chicago Tribune reports that the move is aimed at challenging the decision by a three-judge panel of the court, which ruled 2-1 that the state's longtime ban violated the Second Amendment.

If the court accepts the petition, the case would be reviewed by all 10 appellate judges. If the court rejects the petition, Madigan would have to decide whether to appeal to the U.S. Supreme Court.

"In ruling that Illinois must allow individuals to carry ready-to-use firearms in public, the 7th Circuit Court’s decision goes beyond what the U.S. Supreme Court has held and conflicts with decisions by two other federal appellate courts," Madigan said in a statement issued Tuesday.

"Based on those decisions, it is appropriate to ask the full 7th Circuit to review this case."

December's decision set a 180-day deadline for the Illinois legislature to draft and enact new laws relating to carrying ready-to-use firearms in public. The petition by the attorney general does not affect that deadline.

What is the routine here? Keep asking until you get the answer you want? You can be sure Lisa and her step father Mike have armed personal body guards. It's time to pony up and put armed guards in our schools. NOTHING else will give our kids the protection we can feel good about, and, that won't work all the time either. Many other school districts are coming to that conclusion. Let's do what we realistically can and stop dreaming about confiscating guns or reducing magazine capacities.
